Georgian Trade Unions' Confederation (GTUC) embraces 25 organizations (two regional and 23 sectoral organizations). It has 259172 members (~ 45% of all hired workforce of the country), 204532 of which are regularly paying membership fees to Trade Unions. Members are paying 1% of their salaries to primary organizations set up in their workplaces, in average 49% (~ 0.49% of salary in average) of this amount goes to sectoral/regional organizations, and 5% of the latter (~ 0.03% of salary in average) goes to GTUC monthly budget. In average, this is 0.01 GEL (~ 0.005 USD) per member, i.e. nearly 2000 GEL (~ 1100 USD) per month.

 Based on the Joint Statement dated 31 October 2008 and on the conducted consultations the social partners have reached the following

 

Tripartite Agreement

I

In order to conduct an effective social dialogue the following Workplan has been elaborated:

- The Social Partners: representatives of the Government, Employers’ Association and Confederation of the Trade Unions will meet at least biweekly in order to discuss the current socio-economic situation and to solve the raised problems
- In the format of the tripartite dialogue in order to discuss the problematic issues the parties shall invite experts additional five people from each side
- In order to solve the problems the parties will carry out specific joint activities
- The activities will take place in the format of the ad hoc commission, for which the temporary terms of reference will be developed
- The ad hoc commission will make decisions on the basis of the consensus
- The decisions of the ad hoc commission will be binding for the parties
- The Georgian Government will allocate respective funding for the functioning of the ad hoc commission, as well as for organizing the meetings in the framework of the tripartite dialogue
- The Government will appoint a person responsible for organizing the meetings, taking the minutes and other procedures in relation to the decisions made, the person will be funded by the Government to the extent possible

 


II


In the framework of the tripartite dialogue the parties shall

- discuss the legislative initiatives connected to the social and economic issues
- develop activities, as in terms of legislation so in terms of practice, in order to reach the progress inter alia related to the Labor Code, Collective Bargaining and Freedom of Association
- expand cooperation and consultations with the International Labor Organization in order to carry out activities related to securing the decent work and life conditions

The specific decisions reached in the framework of the dialogue shall at least carry the recommendation character for the Government, which during the decision making process will be respected by the parties.

The tripartite dialogue and specific activities shall also be conducted in relation to the following issues:

1. The healthcare activities for employed in both formal and informal sector
2. Situation in connection to the protection of both workers’ and employers’ interests and rights
3. Protection of the health and safety conditions in the work places
4. Development of the safe work standards in different sectors of economy (e.g. construction, mining etc.)
5. Unemployment insurance systems
6. Reform of the pension system
7. Development of the tripartite dialogue on the regional level


Changes and additions to this agreement can be introduced based on the agreement between the parties.


Every six months from the signature date of this agreement the social partners and the government shall evaluate the progress reached in relation to fulfillment of this agreement and discuss the future steps and related activities.
